Consumer Products Warranty Agreement
Definitions:
Seller: Russell Armstrong trading as The Wizard of NAS at <address removed>
Seller’s Website: https://www.ebay.co.uk/str/thewizardofnas
Seller’s Email Address: <email address removed>
Buyer: The person or Company at the address listed on the “Order Details” page on the eBay UK website for the Ordered Products
Eligible Products: Products listed for sale on the Seller’s Website by the Seller with a condition of “Excellent – Refurbished”, “Very Good – Refurbished”, “Good – Refurbished” or “New”
Ordered Products: Eligible Products purchased by the Buyer on the Date of Purchase from the Seller on the Seller’s Website
Courier: The business contracted by the Seller to deliver the Ordered Products to the Buyer
Date of Delivery: The date on which the tracking information of the Courier indicates the Ordered Products were delivered to the Buyer
Date of Purchase: The date on which the Buyer’s order is marked as complete on the Seller’s Website
Warranty Period: 12 months
Full Refund Period: 90 days from the Date of Purchase
Covered Defects: any defect, malfunction or failure of the Ordered Products excluding:
accidental or negligent damage
damage, malfunction or failure arising from improper use or maintenance
cosmetic damage
damage, malfunction or failure due to normal wear and tear
damage, malfunction or failure due to improper installation or configuration
damage, malfunction or failure due to software or hardware incompatibility
damage, malfunction or failure caused by environmental factors such as natural disasters, fires or floods
damage, malfunction or failure due to alteration or modification
Warranty Agreement: this document
Product Coverage:
The Warranty Agreement applies to all Covered Defects on the Ordered Products in the United Kingdom. In the event of Covered Defects in one or more of the Ordered Products the Buyer is entitled to:
Free technical support and assistance from the Seller for the setup, installation and troubleshooting of the Order Products in the first instance.
A repair or a replacement product of equal or better specification at no additional cost to the Buyer or a full refund of the purchase price and any additional postage paid by the Buyer within the Full Refund Period.
Coverage Duration:
The duration of this Warranty Agreement is the Warranty Period which starts from the Date of Delivery.
Limitation of Liability:
In the event of any product failure or malfunction, the Seller is not liable for any losses or damages (consequential or incidental) that may occur. These include (but are not limited to):
Financial loss from lost revenue or downtime
Loss of data or records
Personal injuries or property damage due to accidents or negligence
Intangible losses such as loss of reputation
Owner Obligations:
As the owner of the Ordered Products, the Buyer must ensure they are used and maintained properly and that any damage, malfunction or failure occurring within the Warranty Period is reported to the Seller within 14 days via the Seller’s Email Address. The Seller will then provide instructions for troubleshooting or arrange for the return (prepaid shipping label will be provided), repair or replacement of the Ordered Products.
Exclusive Rights:
The Seller will fairly evaluate all warranty claims based on the Warranty Agreement. The Seller reserves the right to request additional information or diagnostics to determine eligibility for warranty service. All decisions made by the Seller are final and cannot be appealed. Any disputes arising from or related to the Warranty Agreement shall be resolved through binding arbitration or mediation.
Consumer Rights:
The Warranty Agreement does not affect the Buyer’s Statutory Consumer Rights.
